Hello i brought an item off ebay and was wondering whether anyone knew the best way to get your money back off the seller.
Any help would be appreciated thanks.

If you paid by PayPal you can lodge a complaint with them. If they can't get your money back they pay out on insurance. I have done this before.

How long since you paid for it?
 
I paid throught bank deposit and I haven't recieved the item yet. I have opened a dispute and now the seller have been suspended from ebay?
 
open a dispute through ebay.

The dispute process is a waste of time. I purchased a small, cheap item from the U.S., paid for it (including foreign currency transaction fee) and the seller refused to ship it. He re-credited me the purchase price but I copped another foreign currency transaction fee. I opened a dispute, got him to agree to ship, paid again (another foreign currency transaction fee) and had him refuse again and re-credited me the purchase price (again another foreign currency transaction fee).

I complained to Ebay again that his auctions were misleading (ship worldwide), they came back with "yeah, we know" but didn't do anything & closed the complaint.

Wow, a small cheap item, you thought was so important that you would go through 3 foreign currency transaction for? What was it?

I never had a problem with the process.

There are always going to be bad eggs especially when dealing with stranger who live on the other side of the world.

Since you didn't pay by Paypal ebay may not be too successful, unless he needs to sell on ebay again, in which case he might come around and deliver to get his ban lifted.

If the seller is in Aus and it is not over a few thousand dollars, you can go to the Court House and file a Small Debt Claim...not sure exactly what they call them these days... but if you talk to the court officer they will point you in the right direction.

Larger amounts I think it used to be over about $3,000 in Qld, is a bit more paperwork and you needed to have a lawyer sue to recover your money.

The Court will serve the documents on the other party. If you can provide some paperwork to show you made the payment it should be clear cut. If he doesn't pay by the court hearing the magistrate will make an order that he pays you promptly.

One case I had the shop owner didn't even show up for the hearing. The magistrate made an order in my favour. I went straight around to his shop and demanded he pay me immediately otherwise I would go back to the court and get a garnishee order. He whinged and whined for a few minutes then got me the money.

My hobby is vintage audio gear, it's quite humbling to hold and appreciate technology that was made before my father was born.

always pay by Paypal,

I had case of shoes bought for $81, guy in adelaide, told me he sent to me in Melbourne, 2wks passed still nothing

so sent numerous emails, no replies

lodged complaint then with Paypal (which costs $25.00),

they investigated and awarded me $56.00 (after 2 weeks), low and behold 2 days later the shoes turned up,

the guy then started to email me because I had flamed him, he was claiming he was in hospital, got pissed because Paypal also take the money direct from his account to re-imburse me

I sent my phone no. and asked him to call me to discuss with view for me to pay him but never heard from him

I was told by the bank that they can do a recovery system which will cost 50 dollars or go to the police and lodge a fraud thingo. I think the small claims looks like a good option how much would it cost to lodge one of those?

Slightly off subject but have been on the other end where someone has paid for an item via paypal usibg a stolen card so i lost the item and a little while after was charged a fee by the Card company for accpeting a stolen credit card payment!Also nearly bought an item($4k) but it was priced about 2k lowere than it should have been so i was wary.Seller then came out with a story that they were away at the time so item would be sent by brother in WA-seller gave me an address for WA and also their"current" address in England.Checked both on the equivalent postal services and neither existed:eek:.Moral of that particular episide is if looks too good to be true etc etc etc.Didnt think much of Ebays response in both cases.If you ever sell anything on there be wary of people offering above your asking price(;)this happened a few times with buyers from Indonesia when i was selling mobiles and in all cases they wanted to pay by credit card with various stories of how their dogs auntie chewed their bank card etc:eek:Best of luck with your dispute

Gee I'm not sure. It was quite a few years ago. I may not have paid any lodgement fee at all. If there is a lodgement fee cost and you win it should be added to his bill by the magistrate. Probably best to check that one out with your local Court House.

Might pay to talk to the police too, just to see if you can find out if he is a prolific fraudster. You might be able to use the threat of making an oficial police complaint to get him to come up with the money or goods.
 
I buy heaps of stuff on ebay from round the world have had no problems.. generally i will buy off power sellers from o.s hk, us etc.. all seem good operators.. one off stuffs I try and buy locally and do cod..

Why hasnt the person sent the goods?
Are they in OZ or overseas?
What sort of good and value is the transaction?
Has the seller sold any items before?

The person has just disappeared, suspended from ebay. The seller had sold stuff before, and the item was of a larger value.
 
As others have said, if you pay by paypal you will be ok. You could try sending the seller an email that you will call the fraud squad (there is one especially for internet fraud attached to the FBI) unless they contact you about the item.

You may not get your money back, but when you advise the seller you have reported this to the FBI, at least they wont sleep much for a while either,
 
Ebay themselves do have an insurance system which the limit has been inceased to $1500 i think, used to be $400. I have used it and got some money back on a bad motorcycle purchase that went horribly wrong. This was not a paypal purchase. All the info about claiming is on the ebay site. I emailed them and they sent a email back insructing me what to do. From memory any amounts under $50 were unclaimable. Good luck.
