The Minister had a lawful power to exercise discretion so long as it was rational.I wouldn't characterizing it as that. I would say that it is an expectancy of consistency in the court system, rather than ministerial discretion for political purposes straight out of left field.
This power exists independent of the court system.
All the court system allowed was an appeal .
Your idea that it was out of left field is baseless as it was clear upon Djokorvics arrival that Border Force needed only determine his vaccination status in order to deport him. That's exactly what they did , but they acted with undue haste and denied Djokorvic fairness by the actions.
